Green Card through Asylum

Overview

Asylum is a form of protection that may be granted to a person presently in the United States that allows him to remain in the United States.

As defined in the 1980 Refugee Act, an “asylee” is a person who is unable and unwilling to return to his country of origin due to persecution or fear of persecution based on political opinion, religion, race, nationality or membership in a particular social group and allows him to remain in the United States.

Eligibility Requirements

* Applicants must have been physically present in the United States in asylee status for at least a total of one year prior to filing;
* The reason for remaining in the United States must be to seek protection due to persecution or fear of persecution on account of their race, religion, nationality, membership in a particular social group, or political opinion.
